- Agreement to Terms
By engaging The Poop Troop for our dog waste management services, you (“the Client”) agree to be bound by these Terms and Conditions. Please read them carefully.
- Services Provided
The Poop Troop provides dog waste removal services as agreed upon in your chosen service plan (weekly, fortnightly, or other agreed frequency). Our services include the scooping and removal of visible dog waste from designated areas of your property.
- Service Area and Travel Charges
- Our standard service area covers Bacchus Marsh, Ballan, Melton, Eynesbury, Gisborne and surrounding suburbs within a 10km radius.
- For service requests outside of our standard service area, a travel surcharge will apply.
- The travel surcharge will be calculated at a rate of approximately $0.30 (thirty cents) per kilometer for the round trip distance from the edge of our standard service area to your property.
- The exact travel charge will be calculated based on the shortest practical driving distance and will be communicated to the Client prior to the commencement of services for properties outside the standard service area.
- By agreeing to services outside our standard service area, the Client acknowledges and agrees to pay the applicable travel surcharge in addition to the standard service fees.
- The Poop Troop reserves the right to refuse service to locations deemed too far outside of our service area to be economically or logistically feasible.
- Initial Clean Offer
- The complimentary initial clean is exclusively offered to new clients who sign up for a recurring weekly or fortnightly service plan.
- This offer applies only to the first scheduled clean after the commencement of a new recurring service.
- If a recurring service is cancelled for any period and the Client subsequently re-subscribes, the complimentary initial clean will not apply. The service will resume at the standard recurring service price.
- Access to Property
- The Client grants The Poop Troop permission to access their property on scheduled service days for the purpose of providing the agreed-upon services.
- The Client is responsible for ensuring that the designated areas for waste removal are accessible and free from obstructions (e.g., locked gates, parked vehicles, excessive foliage).
- If access is denied or significantly impeded, resulting in a missed service, The Poop Troop reserves the right to charge the full service fee for that visit.
- Safety and Animals
- The safety of our scoopers is paramount. The Client is responsible for ensuring their dog(s) are secured or otherwise managed in a manner that prevents any potential harm or threat to our staff during service visits.
- If your dog(s) have a history of aggression or if you are unsure how they may react to a stranger in your yard, you must take appropriate precautions to ensure the scooper’s safety. This may include keeping the dog(s) indoors or securely leashed and away from the service area during the scheduled service time.
- If a scooper arrives and feels unsafe due to the presence or behaviour of a dog, they may, at their discretion, refuse service for that visit. In such cases, the full service fee may still apply. The Poop Troop will attempt to contact the Client to discuss future service arrangements and safety protocols.
- Waste Disposal
- The Poop Troop will collect and remove dog waste from your yard.
- Unless otherwise agreed upon, The Poop Troop will dispose of the collected waste in your general waste bin.
- All poop is double baged before being placed in the bin.
- Service Schedule and Rescheduling
- The Poop Troop will adhere to the agreed-upon service schedule to the best of our ability.
- In the event of severe weather conditions (e.g., heavy rain, thunderstorms, extreme heat, flooding) that make service unsafe or impractical, The Poop Troop reserves the right to reschedule services. We will make reasonable efforts to notify clients of any such delays or cancellations.
- We will aim to reschedule missed services as soon as reasonably possible, but we cannot guarantee a specific timeframe.
- Clients needing to reschedule a service must provide at least 24 to 48 hours’ notice. Failure to provide sufficient notice may result in the full service fee being charged.
- Payment Terms
- The Client agrees to pay The Poop Troop the fees outlined in their chosen service plan.
- Payment methods accepted are: direct deposit or debit/credit card. Cash may be accepted if discussed prior, and the correct amount is given (our scoopers do not carry cash).
- Invoices for recurring services will be issued on a calendar monthly, after the last service for the month.
- Payment must be received by the due date or the yard will not be serviced, unless otherwise prior discussed and agreed upon with The Poop Troop.
- Payment is due within 7 days of the invoice date.
- Late payments may result in non scooping of your yard until payment is received or otherwise discussed with The Poop Troop prior.
- The Poop Troop reserves the right to suspend or terminate services for accounts with outstanding balances.
- Recurring Services and Cancellation Policy
- Our recurring weekly and fortnightly services are billed in advance on a monthly calendar basis. For example, a billing cycle may run from the 16th of the current month until the 15th of the following month.
- There are no lock-in contracts for our recurring services. Clients have the right to cancel their recurring service at any time by providing The Poop Troop with at least 7 days to 48 hours written notice via email.
- Upon cancellation, no refunds will be provided for any remaining portion of the current paid billing period.
- Following cancellation, The Poop Troop will continue to provide services for the remainder of the paid billing period, unless otherwise discussed.
- The Poop Troop reserves the right to terminate services at any time with reasonable notice.
- Cancellation of a recurring service before the completion of any agreed-upon minimum term (if you ever decide to implement one for specific promotions in the future) may result in the forfeiture of any discounts or special offers received.
- Limitation of Liability
- To the maximum extent permitted by law, The Poop Troop shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to our services or these Terms and Conditions.
- Our total liability to the Client for any claim arising out of or relating to our services or these Terms and Conditions shall not exceed the total amount paid by the Client to The Poop Troop in 7 days preceding the event giving rise to the liability.
- Indemnification
The Client agrees to indemnify and hold harmless The Poop Troop, its officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- The Client’s breach of these Terms and Conditions.
- The Client’s negligence or willful misconduct.
- Any injury or damage caused by the Client’s dog(s) to The Poop Troop’s personnel or equipment.
- Any unsafe conditions on the Client’s property that were not disclosed to The Poop Troop.
- Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Victoria.
- Entire Agreement
These Terms and Conditions constitute the entire agreement between the Client and The Poop Troop and supersede all prior or contemporaneous communications and proposals, whether oral or written, relating to the subject matter herein.
- Amendments
The Poop Troop reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on our website and will be effective immediately upon posting. Continued use of our services after the posting of revised Terms and Conditions constitutes acceptance of those changes.
